Wills Service

Most people have a clear picture of how they would want their estate dealt with, but don’t put in place the detailed instructions and legal forms that will ensure the assets they have built up over a lifetime are used as they wish.

For business owners the preparation of a will is more complex, often involving important questions of succession planning, control and reward, so the owner’s will is also a key business document.

Edwards Irvine & Facius Pty Ltd bring together their business understanding and their legal practitioners drafting skills necessary to effectively implement your wishes.

We also offer an affordable basic wills service for simple wills for singles and couples via Willcraft Services Australia Pty Ltd.

What Is A Will?

A will is a written document in which you state how you want your property distributed after you die. A person who makes a will is called a “testator’. Making a will allows you to choose what happens to your assets after you die. It also allows you to nominate an executor, who is the person responsible for making sure your wishes are met.

Duties Of An Executor

Basically the duty of an executor or administrator is to collect the assets of the deceased and distribute them to the beneficiaries. How this is done depends on the will and the nature of the estate. A beneficiary does not own the property until the executor distributes the estate.

What Happens If I Die Without A Will?

If you die without making a will, you are said to have died intestate. If this happens, your next of kin will have to apply to the Supreme Court for Letters of Administration, which will allow them to distribute your estate in a certain way. If you are the next of kin of someone who has died intestate, you should seek legal advice. If you die intestate, your assets will be distributed in a certain order, as set out under an act of parliament. Therefore, the outcome may not be one that you would have desired. Therefore, to ensure that your assets are distributed in accordance with your wishes after your death, it is essential that you make a will.
